Kastre Vallavalitsus palub abi ehitusseadustiku ja planeerimisseadustiku
küsimustes. Probleemil on kaks külge ning kuna ühe puhul on tegemist
planeeringuküsimusega adresseerime kirja Majandus- ja
Kommunikatsiooniministeeriumile ning teiselt küljelt on probleem ka
valedel alustel välja antud ehitusloaga, siis edastame kirja ka
Kliimaministeeriumile.



1.	Haaslava Vallavalitsus on 27.10.2006 kehtestanud Arteesia ja
Anikva detailplaneeringu
<https://evald.ee/kastrevald/#/planeeringud/id/122> . Detailplaneeringu
alusel moodustati elamukrundid ning alustati ehitustegevusega. Lisaks
elamutele näeb detailplaneering ette ka kergtee ehitamist, milleni ei ole
tänasel päeval veel jõutud. Detailplaneeringu esialgne koostaja võõrandas
planeeringu järgmisele isikule, väidetavalt pankrotivarana ning uus omanik
jätkas elamute ehitamise ja kruntide müümisega. Kergteed ei ole aga uus
planeeringu elluviija ehitanud ning keeldub selle ehitamisest väitega, et
tema ei ole planeeringu koostaja ning on selle pankrotivarana omandanud
ning seetõttu puudub temal kergtee ehitamise kohustus. Kahjuks ei ole
2006. aastal ega ka hiljem sõlmitud ühtegi halduslepingut, mis sätestaks
täiendavaid tingimusi või ajaraami. Käesoleval juhul on vald seisukohal,
et planeeringu elluviijal tuleb siiski planeeringujärgsed tegevused lõpuni
viia. Paluksime selles küsimuses seisukohta.



2.	Järgmine probleem on planeeringuala välja antud ehitusloaga.
Nimelt on Kastre Vallavalitsus 08.02.2018 väljastanud Pargi tee 12
kinnistule ehitusloa üksikelamu ehitamiseks. Paraku ei ole ehitatav hoone
kooskõlas alal kehtiva detailplaneeringuga: planeeringu järgi pidi
asukohale tekkima kolm üksikelamu krunti ja kergtee, mis viib järgmise
arenduse juurde kuid jagamistoimingud on tegemata ning alles on jäetud üks
suur krunt, sh ei ole välja mõõdetud ka kergtee alla minevat osa.
Olemasolevale krundile on rajatud vallavalitsuse poolt väljastatud
ehitusloaga hoone, mis paikneb väljapool detailplaneeringus näidatud
hoonestusala ning planeeringujärgse kergtee peal. Lisaks ei ole hoone
suurus kooskõlas planeeringus lubatuga. Planeering ei näe ette ka tiigi
rajamist, mille on aga kinnistu omanik ehitusloa alusel rajanud.
Kokkuvõtvalt ei ole Pargi tee 12 kinnistul rajatud hoone kehtiva
detailplaneeringuga kooskõlas. Hoone omanik on aga esitanud kasutusloa
taotluse ning vald seisab dilemma ees – kuidas väljastada kasutusluba
hoonele, mis ei vasta detailplaneeringule? Kinnistu omanik rõhutab, et
vallavalitsus on ehitusloa väljastanud. Vallavalitsus möönab, et luba on
ilmselgelt valesti välja antud ja vallavalitsus usaldas pimesi ametniku
poolt koostatud dokumenti. Paluksime antud küsimuses seisukohta.



Siinkohal on vallavalitsusel olukorra lahendamiseks järgmised ettepanekud:

a.	Nõuda Pargi tee 12 kinnistu omanikult (kes on juhuslikult ka
planeeringu elluviija) olemasoleva detailplaneeringu osalist tühistamist
ning nõuda uue planeeringu koostamist, et elamu kasutusluba oleks
kooskõlas kehtivate dokumentidega. Teame, et sellisel juhul soovib omanik
planeeringu tühistada ka kergtee rajamise osas kuid sellega ei saa vald
nõustuda, sest tänaval liigub palju inimesi ning kergtee on piirkonnas
oluline.
b.	Tühistada Pargi tee 12 ehitusluba ning nõuda uue ehitusloa
taotlemist, mis oleks kooskõlas kehtiva detailplaneeringuga. Uus
ehitusluba tähendaks sisuliselt aga hoone lammutamist, sest sellisel kujul
ei vasta see detailplaneeringule. Sellisel juhul riskib vald aga
kohtukutsega kinnistu omaniku poolt, sest erinevatest kohtulahenditest
võib lugeda, et kui loa andja on eksinud ning olukorra seadustamine on
teisele osapoolele liiga kulukas, tuleb vallavalitsusel kasutusluba välja
anda.





Oleksime väga tänulikud kuid leiaksite aega abi ja nõu anda, sest
vallavalitsus on üsna suure probleemi ees.
